Right of Withdrawal

The buyer has the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen (14) calendar days from the day of receipt of the products purchased on Blipers.it. The communication of the withdrawal must be sent by email to the address info@blipers.it.

The right applies to the product purchased in its entirety; it is not possible to withdraw only from part of the purchased product.
Following confirmation from the seller Blipers Srl, sent by email to the buyer, the agreed return or exchange service can proceed according to the conditions indicated in the following paragraphs. It will then be the buyer’s responsibility to ship the product to the warehouse, bearing the related cost, based on the data indicated below.

Following confirmation of the shipment by the buyer, by sending the data or photo of the shipping slip via email (info@blipers.it) or by message/WhatsApp (+393392717378), the seller will proceed to issue a full refund of the order in case of return, or to ship the new product requested as a replacement by the buyer, in accordance with the seller’s actual stock availability.

IMPORTANT: the Right of Withdrawal may not be exercised by professional Customers including but not limited to retailers, wholesalers, subjects having a VAT registration number, etc.

– In such a case, the item(s) shall be sent back to the Seller by supplying a shipper with it/them within ten (10) working days from the date of receipt of the item(s)by the Buyer.

– According to the law, the freight costs relating to the return of the item(s) shall be borne by the Customer; they only refer to the return of the item(s), not to the first shipment of the latter since these costs are included in the purchase price and will be paid back to the Buyer.

– The Right of Withdrawal is considered as properly exercised if the following requirements are fulfilled:
the right of withdrawal shall properly be exercised within 10 (ten) working days from the date of receipt of the item(s);
ID tag/label must be linked to item(s) since it is an integral part of it/them;
the item(s) shall be sent back in its/their original package (including outer packing and possible literature, as well as possible ancillary elements: accessories, receipt (a copy would be sufficient), certification, etc.);
the item(s) must be given back within ten (10) working days from receiving it/them.
– In order the original package not to be damaged, it is advisable to insert it in a second box; moreover, neither labels nor adhesive tapes shall directly be positioned on the original package.

– According to the law, the freight costs relating to the return of the item(s) shall be borne by the Customer; they only refer to the return of the item(s), not to the first shipment of the latter since these costs are included in the purchase price and will be paid back to the Buyer, as per following article 7.

– The Customer assumes full responsibility for the shipment until proof of receipt at our warehouse; in case the item(s) is/are damaged when transported, Blipers Srl will inform the Customer about the occurrence (within 5 working days from the date of receipt of the item(s) at their warehouse), in order to allow him to make a complaint to the subject that has collected the shipment and obtain the reimbursement equivalent to the value of the item(s) (if insured); in such a case, the item(s) shall be put at Customer’s disposal, at the latter’s expense, with contextual cancellation of the withdrawal claim.

– The consumer will be liable only for the decrease in the value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and operation of the goods.

– If the packaging and / or the original packaging are damaged, Blipers Srl will deduct from the refund due a percentage, but not more than 10% of it, as a contribution to the costs of restoration.

– In case of cancellation of the right of withdrawal, Blipers Srl will inform the Customer within 5 working days from the date of receipt of the item(s) at the latter’s warehouse.
Refund Time and Method

Subject to possible costs to be borne for making good the item(s) in case of damages assessed and relating to the original packing or a possible cancellation of the withdrawal according to the preceding paragraph, Blipers Srl undertakes to pay back the whole amount already paid by the Customer to the latter, within 30 days from the date of receipt of the withdrawal notice.
According to the law (Decree law 206/05), the freight costs relating to the return of the item(s) shall be borne by the Customer; they only refer to the return of the item(s), not to the first shipment of the latter since these costs are included in the purchase price and will be paid back to the Buyer, as per this article.
The Customer undertakes to promptly transmit his bank data to be utilized to send him the refund whiose payment shall exclusively be issued by bank transfer. The bank data shall include the IBAN code (ABI & CAB code numbers – account number) of the holder of the sales invoice.

Forfeiture of the Right of Withdrawal

In the aforementioned cases, Blipers Srl will inform the Customer that the item(s) can be collected at the latter’s premises at Maresca S.r.l. Via Mentana, 30-32-34 – 46019 Cizzolo (Mantova) – Italy or shipped (with freight costs to be borne by the Customer) to the address the Customer will transmit to Maresca S.r.l. by registered letter with advice of receipt, or telefax, or telegram, or email, or certified email system.

After sixty (60) days from the date of message sent by Blipers Srl/Maresca Srl to the Customer without collection of the goods by the latter, nor notification by him to Blipers Srl about the address the goods must be sent to, Blipers will acquire complete property right to the item(s) and be therefore entitled to utilize it at will, with no responsibility toward the Customer.

Warranty

All the item(s) sold by Blipers Srl and bearing Blipers trademark is covered by warranty in terms of defects and/or faults and/or non-compliance with the order caused by Blipers Srl, in case the relevant claim is lodged against Blipers Srl within eight (8) days from the date of receipt of the item(s), with contextual shipment of the item(s) deemed as faulty.
To benefit from the warranty right, the Customer shall keep the receipt accompanying the goods delivered to him. When the Customer accepts the purchase contract, he also acknowledges and accepts the terms and conditions this warranty refers to.

Return

In case of products covered by warranty, the Customer shall give them back to Blipers Srl along with his complaint as provided by the preceding article 9 “Warranty”; the products shall be sent back in their original and complete packaging (including outer packing and possible ancillary elements).
To avoid damages to the original package, Blipers Srl suggests to insert it in a second box; in any case, neither labels nor adhesive tapes shall directly be positioned on the original package. The freight costs relating to the return of the item(s) deemed as faulty shall be borne by the Customer. Blipers Srl will check the item(s) and in case they establish the validity of the Customer’s complaint, they will provide replacing the faulty item(s) with other item(s) having the same properties of the items received by the Customer, depending on its/their availability at Blipers Srl’s warehouse. Blipers Srl will inform the Customer about the latter. The shipment of the replacement item(s) to the Customer will be carried out by Blipers Srl and the relevant freight costs will be borne by the latter.
